These Terms and Conditions (the “Terms”) govern your access to and use of the Echoes of Kin Genealogy, LLC website (https://echoes-of-kin-genealogy.com), digital downloads, print-on-demand merchandise, research services, and any related content (collectively, the “Services”). Echoes of Kin Genealogy, LLC is a professional genealogy research and resource provider based in Las Vegas, Nevada.

By accessing or using our Services, purchasing our digital products, ordering physical merchandise, or engaging our research services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

1. Acceptance of Terms

  • Have read, understood, and agree to be bound by these Terms;
  • Are at least 18 years of age or the age of majority in your jurisdiction; and

2. Permitted Use & License Terms

2.1 Services & Research Content License

Echoes of Kin Genealogy, LLC provides genealogy research, digital workbooks, printable tracking sheets, educational guides, and related services to help you explore and document family history. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use or for internal use within your family or household (or individual client research project management for professional genealogists).

You may, for your own personal, family, or client management purposes:

  • View, download, and retain copies of research reports, family trees, digital workbooks, printable forms, and records provided to you through the Services;
  • Share research results with family members or other individuals involved in your family history projects;
  • Use the information and worksheets we provide as a starting point to conduct further independent research; and
  • Print or store copies of digital materials for your personal records or project binders.

2.2 Digital Downloads & Printable Forms Restrictions

When you purchase or download any digital product from https://echoes-of-kin-genealogy.com (including free forms, paid workbooks, checklist toolkits, or quick start guides), you may not:

  • Resell, re-license, redistribute, share, sub-license, or upload our digital PDF files or workbooks to any public forum, website, file-sharing platform, cloud directory, or social media group;
  • Claim ownership or authorship of any Echoes of Kin Genealogy, LLC design, layout, worksheet, or content; or
  • Modify, alter, or create derivative works from our PDF files for commercial resale.

2.3 Prohibited Uses

You agree that you will not, and will not permit others to:

  • Use the Services or any research, records, digital workbooks, or content provided for any unlawful, harmful, or misleading purpose;
  • Sell, license, sublicense, distribute, publicly display, or otherwise commercially exploit research reports, family trees, records, or digital products obtained through the Services, except with our prior written consent;
  • Misrepresent the origin, accuracy, or authorship of genealogical findings derived from our research or workbooks;
  • Use the Services to infringe upon the privacy, publicity, or other rights of any individual, including living family members;
  • Upload, share, or submit content that is defamatory, harassing, hateful, obscene, or otherwise objectionable;
  • Attempt to gain unauthorized access to the Services, user accounts, or our systems or networks;
  • Use automated tools (such as bots, scrapers, or spiders) to access, collect, or index any portion of the Services without our express written permission; or
  • Reverse engineer, decompile, or otherwise attempt to derive the source code or underlying structure of any part of the Services or digital assets.

We reserve the right to suspend or terminate your access to the Services and revoke digital product licenses if we reasonably believe you have violated these Terms or engaged in any misuse of the Services.

2.4 Research Timelines & Project Completion Expectations

Genealogical research is a thorough, forensic, and painstaking process that requires systematically searching historical repositories, transcribing archival documents, evaluating indirect evidence, and analyzing complex records.

  • No Guaranteed Quick Turnarounds: Unlike automated database searches, custom professional research requires dedicated analysis time. Estimated project completion dates provided in proposals or estimates are good-faith targets, not guaranteed deadlines, as research times vary depending on record availability, archival responsiveness, and repository access.
  • Scope & Phased Delivery: Research projects are conducted in structured hours or phases as defined in your individual client proposal or agreement. Once contracted hours or scope items are fulfilled, additional research requires a new agreement or scope expansion.
  • Archival Delays: Echoes of Kin Genealogy, LLC is not liable for delays caused by government record offices, court clerk processing backlogs, archive closures, or third-party repository turnaround times.

3. Physical Merchandise & Print-on-Demand Orders

All physical apparel, mugs, home decor, accessories, and printed goods sold on https://echoes-of-kin-genealogy.com are custom made-to-order through third-party printing partners.

  • Order Accuracy: You are responsible for providing an accurate shipping address and selecting the correct sizes, colors, and quantities prior to checkout.
  • Production & Shipping: Processing and shipping times are estimates and are not guaranteed. We are not liable for shipping delays caused by carrier delays, severe weather, or customs processing.

4. Payment, Refunds, & Claims

4.1 Payment Processing

All prices are listed in U.S. Dollars ($USD). By placing an order for merchandise, research services, or digital downloads, you represent and warrant that you have the legal right to use the payment method provided.

4.2 Digital Download Refund Policy

Due to the instant, electronic nature of downloadable files, all sales of digital downloads (free or paid) are final. No refunds, exchanges, or cancellations will be granted once a digital file has been purchased, delivered, or downloaded.

4.3 Physical Merchandise Return & Claim Policy

Because physical merchandise is custom print-on-demand, we do not accept general returns, exchanges, or refunds for buyer’s remorse, wrong size selections, or address entry errors.

  • Damaged or Defective Items: Any claims for misprinted, damaged, or defective merchandise must be submitted in writing to michelle@echoes-of-kin-genealogy.com within 15 days of receipt. Approved claims resulting from production errors will be replaced or covered at our expense. (All official print partner claims must be finalized within 30 days of product receipt).
  • Packages Lost in Transit: Claims for packages lost in transit must be submitted to michelle@echoes-of-kin-genealogy.com no later than 15 days after the estimated delivery date.

5. Intellectual Property & Ownership

5.1 Our Content and Materials

Except for User Content (defined in Section 6), all content, materials, and intellectual property made available through https://echoes-of-kin-genealogy.com are owned by or licensed to Echoes of Kin Genealogy, LLC and are protected by United States and international copyright, trademark, and other applicable laws. This includes, without limitation:

  • Digital workbooks, printable worksheets, checklist toolkits, and quick start guides;
  • Research reports, narrative histories, summaries, and written interpretations;
  • Curated genealogical charts, diagrams, product mockups, and family trees prepared by us;
  • Website text, design, graphics, logos, branding, and layout; and
  • Any proprietary tools, methodologies, or processes we use to conduct research.

Subject to the limited rights granted in these Terms, we retain all right, title, and interest in and to our content and materials. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices on or in materials obtained through the Services.

5.2 Ownership of Research, Documents, and Compiled Family Trees

As part of our research Services, we may provide you with research findings, compiled records, and family trees based on publicly available records, third-party resources, and information you provide to us. You are granted a personal license to use these materials for your own genealogical and family-history purposes. While you may share these materials with your family, Echoes of Kin Genealogy, LLC retains ownership of the original research format, presentation, layout design, and compiled work product.

Nothing in these Terms prevents you from using the factual genealogical information (such as names, dates, and relationships) that results from the research in any manner you choose. However, you may not reproduce or redistribute our written narratives, report structures, workbook designs, or proprietary work product for commercial purposes without our prior written permission.

6. User Content

“User Content” means any information, data, documents, photos, stories, family trees, or other materials that you submit, upload, or otherwise provide to us or through https://echoes-of-kin-genealogy.com, including personal or family details you share in connection with our research services or custom product creation.

6.1 Your Responsibilities

By providing User Content, you represent and warrant that:

  • You have all necessary rights, permissions, and authority to share the User Content with us;
  • The User Content does not infringe or violate any third-party rights, including privacy, publicity, copyright, or other intellectual property rights;
  • The User Content is, to the best of your knowledge, accurate and not intentionally misleading; and
  • You will not submit sensitive personal information about living individuals without a lawful basis and, where appropriate, their explicit consent.

6.2 License You Grant to Echoes of Kin Genealogy, LLC

To enable us to provide the Services, you grant Echoes of Kin Genealogy, LLC a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, and create derivative works from your User Content solely for the purposes of:

  • Conducting genealogical research and analysis on your behalf;
  • Compiling, organizing, and presenting your family history and related materials;
  • Fulfilling custom physical product orders;
  • Maintaining internal records and backups; and
  • Complying with legal obligations and enforcing our rights.

We do not sell your User Content to third parties. We also do not publish your User Content publicly without your consent, except as may be required by law or as expressly agreed with you in writing.

6.3 Retention and Deletion

We may retain copies of your User Content and related research materials for a reasonable period for record-keeping, quality assurance, and legal compliance. If you would like us to delete certain User Content, you may contact us using the information in Section 13 below. Please note that we may not be able to delete information that we are legally required to keep or that is stored in automated backup systems for a limited period.

7. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, share, and protect personal information and family data in connection with the Services. By using https://echoes-of-kin-genealogy.com, you acknowledge that your information will be handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

  • We use appropriate technical and organizational measures to help protect personal and family data from unauthorized access, disclosure, or misuse;

  • We do not sell personal or family data for marketing purposes.

If there is any inconsistency between these Terms and the Privacy Policy regarding the treatment of personal data, the Privacy Policy will control.

8. Disclaimer of Warranties

Genealogy is an interpretive and research-based discipline that relies on historical records, third-party databases, state/federal archives, and information provided by clients and other secondary sources. While we strive to provide thorough, accurate, and well-supported research and tools, historical records are subject to errors, missing pages, and misinterpretations by original enumerators or indexers.

THE SERVICES, INCLUDING ALL DIGITAL DOWNLOADS, WORKBOOKS, RESEARCH REPORTS, FAMILY TREES, MERCHANDISE, AND CONTENT, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, ECHOES OF KIN GENEALOGY, LLC DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that the Services will be uninterrupted, error-free, or secure, or that any particular genealogical conclusion or ancestral breakthrough is definitive or beyond dispute. Genealogical research often involves reasonable inferences and may change as new historical records become available.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ECHOES OF KIN GENEALOGY, LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICES, DIGITAL PRODUCTS, OR PHYSICAL MERCHANDISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO ECHOES OF KIN GENEALOGY, LLC FOR THE SPECIFIC SERVICES OR PRODUCTS GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

10. Third-Party Links and Services

The Services may contain links to third-party websites, databases, archives, e-commerce tools, or print fulfillment providers that are not owned or controlled by Echoes of Kin Genealogy, LLC. We provide these links and references for your convenience only and do not endorse, control, or assume responsibility for any third-party content, products, or services. Your use of third-party websites or services is at your own risk and is subject to the terms and policies of those third parties. Echoes of Kin Genealogy, LLC is not responsible for any loss or damage arising from your dealings with third parties.

11. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the federal or state courts located in Clark County, Las Vegas, Nevada.

12. Force Majeure (Events Beyond Our Control)

Force Majeure Events include, but are not limited to:

  • Postal & Shipping Disruptions: Courier delays, lost shipments in transit, supply chain interruptions, port closures, or national mail service backlogs;
  • Third-Party & Supplier Disruptions: Print-on-demand fulfillment facility shutdowns, paper or ink shortages, e-commerce platform outages, or payment processor downtime;
  • Government Actions & Archive Restrictions: Federal, state, or municipal government closures, court clerk backlogs, state archive restrictions, or changes in record access laws;
  • Cyber Incidents & Technical Failures: Internet service provider outages, distributed denial-of-service (DDoS) attacks, server host failures, or third-party database security incidents; and
  • Acts of Nature & Emergency Events: Natural disasters, severe weather events, fires, floods, power grid failures, public health emergencies, or civil unrest.

In the event of a Force Majeure Event, our performance obligations under these Terms, client research contracts, and merchandise fulfillment timelines will be suspended for the duration of the event. We will make reasonable efforts to resume normal operations and client communications as soon as practicable.

13. Changes to Terms

We reserve the right to update or modify these Terms from time to time to reflect changes in our practices, the law, or the Services. When we make material changes, we will update the “Last Updated” date at the top of this page.

Your continued use of https://echoes-of-kin-genealogy.com after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
